Welcome to Brannigan Land Services. These Terms & Conditions govern the use of our website and the services we provide. By requesting an estimate, approving a proposal, submitting payment, authorizing work, or otherwise engaging our services, you agree to these Terms & Conditions.

1. Scope of Services

Brannigan Land Services provides professional land clearing, forestry mulching, excavation, grading, drainage improvements, site preparation, dirt work, debris removal, and related services.

The scope of work, pricing, materials, and estimated project schedule will be outlined in the approved estimate, proposal, invoice, or service agreement. Any services requested outside the original scope may result in additional charges.

2. Property Access and Client Responsibilities

Clients are responsible for providing safe and reasonable access to the property and ensuring work areas are accessible to equipment.

Clients must remove vehicles, equipment, and personal property from active work areas and disclose any known hazards, underground structures, or conditions that could impact operations.

Clients are also responsible for identifying property boundaries. If property boundaries are uncertain, we recommend providing a current property survey before work begins.

3. Utilities and Underground Conditions

While public utility locates may be coordinated when required, clients remain responsible for identifying private underground improvements, including but not limited to:

  • Irrigation systems

  • Septic systems and drain fields

  • Landscape lighting

  • Invisible fencing

  • Wells

  • Private utility lines

  • Underground tanks

Brannigan Land Services is not responsible for damage to underground structures or utilities that were not properly disclosed or marked.

4. Hidden Site Conditions

Site conditions below the surface cannot always be identified before work begins.

Hidden conditions may include:

  • Buried stumps and roots

  • Rock formations

  • Concrete

  • Construction debris

  • Abandoned structures or foundations

  • Unsuitable soils

Discovery of hidden conditions may require additional labor, equipment, materials, or disposal services and may result in additional charges.

5. Forestry Mulching Services

Forestry mulching reduces vegetation by grinding trees, brush, and undergrowth into mulch.

Forestry mulching does not guarantee complete removal of root systems, underground vegetation, or future regrowth. Natural regrowth is expected and is not covered by any warranty unless specifically stated in writing.

6. Excavation, Grading, and Drainage Services

Excavation and grading services are performed based on existing site conditions observed at the time of service.

While our goal is to improve site usability and water movement, Brannigan Land Services cannot guarantee:

  • Complete elimination of standing water

  • Long-term drainage performance

  • Prevention of erosion

  • Soil stability

  • Future settlement

  • Suitability for future construction

Results may vary due to weather, soil composition, neighboring properties, groundwater conditions, and future modifications to the site.

7. Change Orders

Any work requested beyond the original scope of the project may require a change order and additional charges.

Approval of additional work may be provided verbally, by email, text message, or in writing.

8. Scheduling and Project Delays

Project schedules are estimates and may be affected by:

  • Weather conditions

  • Equipment availability

  • Material availability

  • Permit delays

  • Utility locating delays

  • Site accessibility

  • Other circumstances beyond our control

Brannigan Land Services is not liable for delays resulting from circumstances outside our reasonable control.

9. Weather Conditions

Many of our services are weather dependent.

We reserve the right to postpone, suspend, or reschedule work due to rain, flooding, excessive moisture, lightning, high winds, hurricanes, or unsafe site conditions.

Weather-related delays do not constitute a breach of service.

10. Payment Terms

Payment terms will be outlined in the approved estimate, proposal, invoice, or service agreement.

Deposits may be required before scheduling. Remaining balances are due according to the payment terms provided.

Past-due balances may accrue interest at the maximum rate permitted by applicable law, and clients agree to pay any reasonable collection costs, court costs, and attorney’s fees associated with unpaid accounts.

11. Heavy Equipment Operations

Land clearing, excavation, grading, and forestry mulching require the use of heavy equipment.

Despite reasonable care, equipment operations may result in:

  • Soil disturbance

  • Surface rutting

  • Ground compaction

  • Vegetation disturbance

  • Surface damage associated with normal operations

These conditions are often unavoidable and are considered a normal part of site work.

12. Property Damage Limitations

Brannigan Land Services exercises reasonable care while performing services.

We are not responsible for damages resulting from:

  • Unmarked utilities

  • Undisclosed underground improvements

  • Inaccurate property line information

  • Hidden site conditions

  • Pre-existing defects or conditions

Any claim for property damage must be reported within seven (7) days following project completion.

13. Warranty Disclaimer

Except where expressly stated in writing, Brannigan Land Services makes no warranties, express or implied, regarding:

  • Drainage performance

  • Soil stability

  • Erosion prevention

  • Future vegetation growth

  • Future settlement

  • Site suitability for development or construction

Site conditions are influenced by factors beyond our control and may change over time.

14. Indemnification

Clients agree to indemnify and hold harmless Brannigan Land Services, its owners, employees, contractors, and representatives from claims, damages, liabilities, costs, and expenses arising from:

  • Inaccurate information provided by the client

  • Undisclosed site conditions

  • Client instructions or directions

  • Conditions existing on the property prior to work

  • Client’s violation of these Terms & Conditions

15. Limitation of Liability

To the fullest extent permitted by law, Brannigan Land Services’ total liability for any claim related to services provided shall not exceed the amount paid by the client for the specific services giving rise to the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages.

16. Force Majeure

Brannigan Land Services shall not be responsible for delays or failures resulting from events beyond our reasonable control, including but not limited to:

  • Hurricanes

  • Severe weather

  • Flooding

  • Fire

  • Government actions

  • Labor shortages

  • Supply chain disruptions

  • Natural disasters

17. Independent Contractor Status

Brannigan Land Services operates as an independent contractor and may utilize subcontractors, operators, truck drivers, or specialty service providers as necessary to complete projects.

18. SMS Communications

By providing your phone number, you consent to receive text messages regarding:

  • Estimates

  • Scheduling

  • Appointment confirmations

  • Project updates

  • Customer support

  • Service follow-ups

SMS consent is not shared with third parties or affiliates for marketing purposes.

Carrier Liability Disclaimer

Brannigan Land Services is not responsible for any delays or failures in the receipt of any SMS messages connected with this program. Delivery of SMS messages is subject to effective transmission from your network operator.

Age Restriction:

19. Electronic Acceptance

Electronic approvals, online submissions, email approvals, text message approvals, and payment of invoices constitute acceptance of these Terms & Conditions and are legally binding to the fullest extent permitted by law.

20. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Florida.

Any dispute arising from our services shall be subject to the jurisdiction of the courts located within the State of Florida.
